CLICK2DROP RETURNS POLICY

§ 1. Subject of the Policy and Seller’s data

1. The Policy specifies the rules for voluntary returns of Goods in B2B sales conducted on the Click2Drop platform and statutory withdrawal from the contract in consumer sales conducted directly by ADAMANTA spółka z ograniczoną odpowiedzialnością z siedzibą w Lublinie, ul. Metalurgiczna 62, 20-234 Lublin, KRS (National Court Register) 0001078676, NIP (Tax Identification Number) 7123467638, REGON (National Business Registry Number) 527332151 (hereinafter: “we”/”us”/”our”).

2. Return requests should be submitted via your account or by email sent to support@click2drop.eu. Once a request is submitted, we will provide the address of the returns warehouse. Goods may also be returned to our registered office address, unless a different address has been specified.

3. Part A applies to buyers who are business entities, subject to the provisions which grant consumer protection to certain natural persons conducting business activity. Part B applies exclusively to contracts in which we ourselves act as the seller towards a consumer.

PART A. VOLUNTARY B2B COMMERCIAL RETURNS

§ 2. Timeframe and scope of the return

1. A Buyer who is a business entity may request a return of goods within 30 days of the date of their delivery to the address specified in the order. Such a request may also pertain to goods returned to the Buyer by their own customer, provided that the terms and conditions set out in this Policy are met.

2. Returned goods must be complete, undamaged, and in a condition suitable for resale, including their original packaging, if such packaging is necessary for further sale. It is permissible to examine the goods in a manner that does not compromise their commercial value. Goods that have been used or damaged due to reasons attributable to the Buyer or the Recipient are not eligible for voluntary return.

3. Goods made to individual specifications, perishable items, or sealed hygiene products that have been opened may be excluded from the right of return, provided that the Buyer was informed of this exclusion prior to the purchase. Such exclusions do not limit claims arising from the improper performance of the contract.

§ 3. Submitting a return request and sending back the item

1. Return requests are submitted via the Account on the platform or to the following address: support@click2drop.eu. Your order number, the name and quantity of the items to be returned and your contact details must be provided.

2. We acknowledge the request and provide the return address along with instructions on how to label the shipment. The Buyer must return the goods within 7 days of receiving this information. The request number is used to identify the shipment; however, its absence does not justify a refusal to accept a return that was submitted within the required timeframe.

3. The Buyer is responsible for arranging and paying for the return shipment. The Buyer must secure the goods in a manner appropriate to their nature. The risk of accidental loss of or damage to the return shipment lies with the Buyer until it is delivered to the address provided.

4. We do not charge a handling fee or a restocking fee for the acceptance and processing of a valid commercial return.

§ 4. Verification and settlement of a B2B return

1. Upon receipt of the shipment, we verify its contents and the condition of the goods. In the case of any doubts, we may request clarifications or documentation from the Buyer regarding the return requested.

2. We confirm receipt of the return and process the refund. We issue a corrective invoice in accordance with applicable regulations, including via KSeF (National E-Invoice System), if required.

3. The price is refunded promptly upon acceptance of the return, using the same payment method or by way of an agreed-upon settlement of accounts. Fees for the properly rendered logistics and transport services are not automatically refunded.

4. Voluntary commercial returns do not replace the formal complaints process, nor do they limit rights arising from mandatory legal provisions.

PART B. WITHDRAWAL FROM THE CONTRACT BY THE CONSUMER

§ 5. Right of withdrawal and withdrawal period

1. A consumer who has entered into a distance sales contract directly with us may withdraw from it without providing a reason within 14 days of receiving the goods. In the case of an order involving goods delivered separately or in instalments, the period begins upon receipt of the last item, instalment, or part. In the case of regular delivery of goods over a specified period, the period begins upon receipt of the first item.

2. To withdraw from the contract, it is sufficient to send an unequivocal statement to support@click2drop.eu or by mail to our registered office before the deadline expires. You may use the template provided at the end of the Policy, though this is not mandatory.

3. This part of the Policy does not apply to purchases made by a consumer in the online store of another business entity, even if the delivery of their order was fulfilled by a Click2Drop warehouse. In such a situation, the seller operating the given store remains the party to the contract with the consumer.

§ 6. Returning goods and costs

1. The consumer must return the goods promptly, no later than 14 days from the date of submitting the statement of withdrawal. The deadline is met if the shipment is dispatched before it expires. We provide the address of the returns warehouse once we receive the return request; if however we fail to specify this address, goods may still be returned to our registered office.

2. The direct cost of returning the goods is borne by the consumer, provided that they were duly informed of this prior to the conclusion of the contract; this does not apply if we have agreed to bear such cost or if otherwise provided by law. In the case of goods that cannot normally be returned by post, information regarding the estimated cost of return is provided prior to the conclusion of the contract, in accordance with the applicable legislation.

3. The consumer is liable for any reduction in the value of the goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods. The mere opening of the standard packaging does not mean that you lose your right of withdrawal.

§ 7. Refund of payment

1. We will refund the payments received from the Consumer, including the cost of the least expensive standard delivery method offered at the time of purchase, without undue delay and no later than 14 days from the date of receipt of the statement of withdrawal.

2. We may withhold the refund of payment until we have received the goods or the consumer has provided proof of having sent them back, whichever occurs first.

3. The refund is made using the same payment method as the one used by the Consumer, unless the Consumer has expressly agreed to a different method that does not involve any additional costs for them.

§ 8. Exceptions to the right of withdrawal

1. The right of withdrawal does not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular with regard to non-prefabricated goods manufactured according to the Consumer's specifications or intended to meet their individual needs, goods that are liable to deteriorate rapidly, and goods supplied in a sealed package which cannot be returned after opening due to health protection or hygiene reasons, if the package has been opened after delivery.

2. The exceptions specified above apply only when all the conditions required by law are met.

§ 9. Complaints and returns

1. A voluntary B2B commercial return and a statutory withdrawal from a contract do not constitute a complaint. Rights arising from a product’s non-conformity with the contract or from the improper performance of obligations remain separate.

2. In the event of a justified consumer complaint, the costs of repair, replacement, and collection of the goods are borne by us to the extent required by law. The terms and conditions for complaints are set out in the policy applicable to the specific contract.

§ 10. Final provisions

1. The returns policy complements the Click2Drop Terms and Conditions of B2B Sales and the Click2Drop Terms and Conditions of Consumer Sales – each of these documents applies to the appropriate type of contract.

2. The returns policy does not limit statutory rights. In the event of any discrepancy between its provisions and mandatory legal requirements, the latter shall apply.
